Drawing from Michel Foucault’s reading of Immanuel Kant’s essay “What is Enlightenment?,” and specifically his definition ofascesis, we associate maturity with a capacity for, and interest in, forming the self. On the basis of an empirical study of making vinyl records following the successful commercialization of digital media, we identify micro-disciplinary techniques of self-forming that emerge as enthusiasts steadily learn the craft of vinyl record manufacturing. It is, we argue, through technology, rather than against it, that organizational immaturity can be (...) resisted. Craftwork involves testing and transforming, rather than just acquiring, traditional skills. Maturity involves an ongoing struggle of selectively and reflectively engaging with technologies via attempts to be the subject of one’s own subjection. The former contributes to the latter. This article describes a project which involved an attempt to integrate an expert system with a hypertext database of primary and secondary text materials. Our chosen legal domain was that of the Convention on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters (The Brussels Convention 1968). In this article, we address three dimensions of system design. With regard to the legal dimension, we consider the choice of domain and the representation of both knowledge and data in the (...) system. On the technological dimension, we discuss the selection of software development tools and problems associated with keeping knowledge bases and databases up-to-date. Finally, we pay particular attention to the Cinderella dimension of legal expert system development — the user interface. (shrink)

Early in the COVID-19 pandemic there was widespread concern that healthcare systems would be overwhelmed, and specifically, that there would be insufficient critical care capacity in terms of beds, ventilators or staff to care for patients. In the UK, this was avoided by a threefold approach involving widespread, rapid expansion of critical care capacity, reduction of healthcare demand from non-COVID-19 sources by temporarily pausing much of normal healthcare delivery, and by governmental and societal responses that reduced demand through national lockdown. (...) Despite high-level documents designed to help manage limited critical care capacity, none provided sufficient operational direction to enable use at the bedside in situations requiring triage. We present and describe the development of a structured process for fair allocation of critical care resources in the setting of insufficient capacity. The document combines a wide variety of factors known to impact on outcome from critical illness, integrated with broad-based clinical judgement to enable structured, explicit, transparent decision-making founded on robust ethical principles. It aims to improve communication and allocate resources fairly, while avoiding triage decisions based on a single disease, comorbidity, patient age or degree of frailty. It is designed to support and document decision-making. The document has not been needed to date, nor adopted as hospital policy. However, as the pandemic evolves, the resumption of necessary non-COVID-19 healthcare and economic activity mean capacity issues and the potential need for triage may yet return. In recent decades, issues that reside at the center of philosophical and psychological inquiry have been absorbed into a scientific framework variously identified as "brain science," "cognitive science," and "cognitive neuroscience." Scholars have heralded this development as revolutionary, but a revolution implies an existing method has been overturned in favor of something new. What long-held theories have been abandoned or significantly modified in light of cognitive neuroscience? _Consciousness and Mental Life_ questions our present approach to the study of consciousness and (...) the way modern discoveries either mirror or contradict understandings reached in the centuries leading up to our own. Daniel N. Robinson does not wage an attack on the emerging discipline of cognitive science. Rather, he provides the necessary historical context to properly evaluate the relationship between issues of consciousness and neuroscience and their evolution over time. Robinson begins with Aristotle and the ancient Greeks and continues through to René Descartes, David Hume, William James, Daniel Dennett, John Searle, Richard Rorty, Hilary Putnam, and Derek Parfit. Approaching the issue from both a philosophical and a psychological perspective, Robinson identifies what makes the study of consciousness so problematic and asks whether cognitive neuroscience can truly reveal the origins of mental events, emotions, and preference, or if these occurrences are better understood by studying the whole person, not just the brain. Well-reasoned and thoroughly argued, _Consciousness and Mental Life_ corrects many claims made about the success of brain science and provides a valuable historical context for the study of human consciousness. This entry concerns dualism in the philosophy of mind. The term ‘dualism’ has a variety of uses in the history of thought. In general, the idea is that, for some particular domain, there are two fundamental kinds or categories of things or principles. In theology, for example a ‘dualist’ is someone who believes that Good and Evil — or God and the Devil — are independent and more or less equal forces in the world. Dualism contrasts with monism, which is (...) the theory that there is only one fundamental kind, category of thing or principle; and, rather less commonly, with pluralism, which is the view that there are many kinds or categories. In the philosophy of mind, dualism is the theory that the mental and the physical — or mind and body or mind and brain — are, in some sense, radically different kinds of thing. Because common sense tells us that there are physical bodies, and because there is intellectual pressure towards producing a unified view of the world, one could say that materialist monism is the ‘default option’. Discussion about dualism, therefore, tends to start from the assumption of the reality of the physical world, and then to consider arguments for why the mind cannot be treated as simply part of that world. Aronofsky’s two companion films The Wrestler (109 min, Wild Bunch, 2008, DVD) and Black Swan (108 min, Fox Searchlight, 2010, DVD). Both films (which were originally intended to be one film, explaining their thematic consistency)1 share three elements. First, both explore cultural forms, wrestling and dance, respectively, that punish the body of the performer in a spectacular way. Second, both films end with the ritualistic dying (if not the death) of the main character. Third, in both films, this dying is accompanied by a kind of transformation that can only be called “becoming-animal.”2 Though this last point is much easier to demonstrate [End Page 207] in the case of Black Swan, I will argue that this is also true for The Wrestler. In interpreting these films, I will rely mainly on René Girard’s ideas about mimetic desire and the surrogate victim mechanism, supplemented by Slavoj Žižek’s notion of symbolic death. Symbolic death or “second death” is Žižek’s Hegelian appropriation of the psychoanalytic death drive. The death drive holds a special place for Girard, since he considers Freud’s formulation of the death drive his admission that the Oedipal complex cannot explain the compulsion to repetition, an admission for which he credits Freud’s honesty. Martin is unable to die properly the first time, Eagleton argues, “because he is incapable of love. Only the good are capable of dying. But while Pincher Martin is defiant and bound for a self-created Hell because of his deliberate rejection of love, Ram is a much more sympathetic character—though no less doomed—because he tries but fails time after time to accept the love of those who could save him. René Guénon (1886-1951) is undoubtedly one of the luminaries of the twentieth century, whose critique of the modern world has stood fast against the shifting sands of recent philosophies. His oeuvre of 26 volumes is providential for the modern seeker: pointing ceaselessly to the perennial wisdom found in past cultures ranging from the Shamanistic to the Indian and Chinese, the Hellenic and Judaic, the Christian and Islamic, and including also Alchemy, Hermeticism, and other esoteric currents, at the same time it (...) directs the reader to the deepest level of religious praxis, emphasizing the need for affiliation with a revealed tradition even while acknowledging the final identity of all spiritual paths as they approach the summit of spiritual realization. The present volume, first published in 1958 by Guénon's friend and collaborator Paul Chacornac, whose bookstore, journal (first called Le Voile d'Isis, later changed to Études Traditionnelles), and publishing venture-Éditions Traditionnelles-were so instrumental in furthering Guénon's work, was the first full-length biography of this extraordinary man to appear, and has served as the foundation for the many later biographies that have appeared in French, as well as the lone biography in English, René Guénon and the Future of the West, by Robin Waterfield. A close reading of Mary Robinson’s late-eighteenth-century poem “London’s Summer Morning,” which captures all the noises and smells of a busy London street, is not enough to convince the reader that it isn’t all a dream. But whose dream? René Descartes and Wallace Stevens suggest that it may not matter.

Several authors have recently suggested that moral factors and norms `encroach' on the epistemic, and because of salient parallels to pragmatic encroachment views in epistemology, these suggestions have been dubbed `moral encroachment views'. This paper distinguishes between variants of the moral encroachment thesis, pointing out how they address different problems, are motivated by different considerations, and are not all subject to the same objections. It also explores how the family of moral encroachment views compare to classical pragmatic encroachment accounts.

I argue that the offense generation pattern of slurring terms parallels that of impoliteness behaviors, and is best explained by appeal to similar purely pragmatic mechanisms. In choosing to use a slurring term rather than its neutral counterpart, the speaker signals that she endorses the term. Such an endorsement warrants offense, and consequently slurs generate offense whenever a speaker's use demonstrates a contrastive preference for the slurring term. Since this explanation comes at low theoretical cost and imposes few constraints on (...) an account of the semantics of slurs, this suggests that we should not require semantic accounts to provide an independent explanation of the offense profile. This article investigates discourses of Sweden’s success in gender mainstreaming. Using the theoretical concept of myth, discourse analysis is performed on different categories of texts. The aim is to analyse how this discourse of success is constructed and to increase the understanding of its components. The themes identified in the reading include adaptation, integration, volume and initiatives. In conclusion, it is argued that a conflation of gender mainstreaming with gender equality has been a vital part of the construction of Sweden (...) as the best case of gender mainstreaming. Law-enforcement agencies are increasingly able to leverage crime statistics to make risk predictions for particular individuals, employing a form of inference that some condemn as violating the right to be “treated as an individual.” I suggest that the right encodes agents’ entitlement to a fair distribution of the burdens and benefits of the rule of law. Rather than precluding statistical prediction, it requires that citizens be able to anticipate which variables will be used as predictors and act intentionally to avoid (...) them. Furthermore, it condemns reliance on various indexes of distributive injustice, or unchosen properties, as evidence of law-breaking. (shrink)

The problem of moral disagreement has been presented as an objection to contextualist semantics for ‘ought’, since it is not clear that contextualism can accommodate or give a convincing gloss of such disagreement. I argue that independently of our semantics, disagreements over ‘ought’ in non-cooperative contexts are best understood as indirect metalinguistic disputes, which is easily accommodated by contextualism. If this is correct, then rather than posing a problem for contextualism, the data from moral disagreements provides some reason to adopt (...) a semantics that allows contextual variance in the meanings of ‘ought’. Each state’s Medicaid Fraud Control Unit prosecutes billing fraud cases against individual healthcare providers who fraudulently bill Medicaid for services provided. Once an individual is convicted of billing fraud, the Office of Inspector General for the Department of Health and Human Services may exclude the individual from billing any federal government healthcare program, including Medicaid. Excluded individuals are added to a public list of exclusions, which restricts their ability to practice professionally. Prompted by criminology research into the impact of policing (...) resources, we test whether these government enforcement initiatives against fraud serve as a deterrent to would-be fraudulent billers. We document that key enforcement proxies, the staffing level and budget of an MFCU, are positively associated with the yearly number of exclusions added at the state level. Our results are consistent with the exclusion list not being a deterrent but provide support for MFCUs’ fraud detection efforts. This paper provides industry-specific fraud insights for auditors and other individuals involved in public policy, specifically Medicaid, and introduces a novel dataset to the accounting fraud research literature. A regulative norm for permissible defense distinguishes the conditions under which we will hold defenders to be innocent of any wrongdoing from those in which we hold them responsible for assault or manslaughter. The norm must strike a fair balance between defenders' security, on the one hand, and other agents’ legitimate claim to live without fear of suffering mistaken defensive harm, on the other. Since agents must make defensive decisions under high pressure and on only partial information, they will sometimes (...) make mistakes. We have reason to want a norm that considers a mistake permissible when it was highly likely on the evidence that defense was proportionate and necessary to avert a threat. However, adopting an evidentialist norm under non-ideal conditions is treacherous business. I briefly survey empirical data suggesting that the type and extent of bias prevalent in the US renders a straightforward evidentialist norm unjust, and thus since the legal practice in the US relies on such a norm, we must explore avenues for reform. Preferably this will take the form of adopting a modified evidential norm, and I explore some promising options. If this proves impossible, however, then we have to accept a strict regulative norm (which does not consider any mistakes permissible), as the sole just alternative. (shrink)

This contribution demonstrates the benefits of a transatlantic history of early modern mining that encompasses both a cross-pollination of approaches and a critical reexamination of the field’s underlying assumptions. It applies to Álvaro Alonso Barba’s 1640 El arte de los metales conceptual frameworks developed by historians of early modern European mining, by scholars of labor and science in the colonial Andes, and by theorists of reader reception and scholarly practice. This analysis offers a revised understanding of Pamela Long’s model of (...) the “trading zone” as a vision of knowledge production promoted by elite Europeans and shaped by the dialogic model of knowledge production taught at European universities. Parallels between Barba and the German humanist and metallurgical author Georg Agricola (1494–1555) underscore the applicability of these findings with respect to Barba for early modern mining more generally. A ‘vestigial social practice' is a norm, convention, or social behavior that persists even when few endorse it or its original justifying rationale. Begby (2021) explores social explanations for the persistence of prejudice, arguing that even if we all privately disavow a stereotype, we might nevertheless continue acting as if it is true because we believe that others expect us to. Meanwhile the persistence of the practice provides something like implicit testimonial evidence for the prejudice that would justify it, making (...) it rational for members of the next generation to acquire the corresponding prejudiced beliefs. This paper distinguishes between three different types of vestigial social practice in terms of the underlying explanatory mechanisms, and argues that the persistence of prejudicial social stereotypes is most tightly linked not to others’ beliefs or expectations, but to the ways that material infrastructure constrains options shapes social outcomes. Given that, the persistence of a practice only provides grounds to infer that most people endorse the corresponding prejudiced belief only if we are in a position to dismiss relevant alternative explanations. Rights to do wrong are not necessary even within the framework of interest-based rights aimed at preserving autonomy. Agents can make morally significant choices and develop their moral character without a right to do wrong, so long as we allow that there can be moral variation within the set of actions that an agent is permitted to perform. Agents can also engage in non-trivial self-constitution in choosing between morally indifferent options, so long as there is adequate non-moral variation among the (...) alternatives. The stubborn intuition that individuals have a right to do wrong in some cases can be explained as stemming from a cautionary principle motivated by the asymmetry between the risk of wrongly interfering and that of refraining from interfering. Despite the amount of public investment in nanotechnology ventures in the developed world, research shows that there is little public awareness about nanotechnology, and public knowledge is very limited. This is concerning given that nanotechnology has been heralded as ‘revolutionising’ the way we live. In this paper, we articulate why public engagement in debates about nanotechnology is important, drawing on literature on public engagement and science policy debate and deliberation about public policy development. We also explore the significance of timing (...) in engaging the public, and we make some suggestions concerning how to effectively engage publics. Our conclusions indicate the significance of scientific researchers, policy makers and representative consumer groupings in public reasoning towards a better public policy framework for debate about technological development. In 1986, philosopher-bioethicist Samuel Gorovitz published an essay entitled “Baiting Bioethics,” in which he reported on various criticisms of bioethics that were “in print, or voiced in and around … the field” at that time, and set forth his assessment of their legitimacy. He gave detailed attention to what he judged to be the particularly fierce and “irresponsible attacks” on “the moral integrity” and soundness of bioethics contained in two papers: “Getting Ethics” by philosopher William Bennett and “Medical Morality Is (...) Not Bioethics,” coauthored by us. Gorovitz attributed some of the criticisms that bioethics was eliciting to the fact that this new, rapidly rising, and increasingly visible field had brought “scholars and practitioners together who otherwise would have little exposure to one another's disciplines. Their interactions are mutually enriching at times,” he declared, “but mutually baffling and even infuriating at other times.” In this latter regard, he suggested that “perhaps” Fox and Swazey's characterization of bioethics in the article he dissected “reflects a general revulsion at endeavors they see as inadequately like the social sciences or insufficiently respectful of them.” He went on to say that despite his objections to our “complaints” about bioethics—especially to our claim that “autonomy [had] been an unduly emphasized value” in the field—he had “a lingering sense” that there might be “a grain of truth” in them. Gorovitz ended his essay with an affirmation about the “benefit” that bioethics can derive from “responsible” and even from “irresponsible” criticism. “The unexamined discipline invites the philosopher's critical scrutiny no less than the unexamined life,” he aphoristically concluded. a.
